PATHETIC REPLY TO OUR LETTER FROM PAUL JAMES, THE DIRECTOR OF THE OFFICE OF TREATY SETTLEMENTS

Thank you for your letter dated the 7 March 2008 and your pathetic response, “The Office of Treaty Settlement has responded to you in previous correspondence about these matters and I have nothing further to add”.

The only time the Office of Treaty Settlements has responded about these matters was when you sent the Deed we had requested under the Official Information Act as Mr Titford and his lawyer Clive Jackson had been refused a copy at the time. It was you who sent the Deed that had been “tampered with” stating, “I trust this satisfies your request”, the reason the Ombudsman agreed to investigate our complaint and found many fraudulent discrepancies with the sale documents and those involved, as shown in my letter.

You were one of the people involved with this document when it arrived back in New Zealand but you sent a document to Mr Titford that a five year old would have known had been “tampered with”. Four clean pages without Mr Titford’s amendment, that had never left New Zealand and the final signing page that had been to Tasmania, signed by Mr Titford and the Crown’s appointed, instructed and paid lawyer, Sam Samec and then returned to New Zealand and signed by the Crown. And the Director of OTS didn’t know it had been “tampered with” and, has nothing to add!!!!

Unfortunately for you Paul, we had a copy of a memo from the Crown Law Office showing concern there had been an amendment made to the Deed, which shows you knew all about this amendment. In fact, the memo is addressed to you, so you must have known this was not the Deed Mr Titford and the Crown had signed. The document you sent to Mr Titford, was a compiled document so the Crown could continue to lie to the public that Manuwhetai was wahi tapu and defraud Mr Titford of his freehold titled property. In the original Deed that Helen Aikman, Mary-Anne Thompson and you had been so concerned about, shows the Crown had admitted and agreed, Manuwhetai was only “alleged” to be wahi tapu.

I believe, “you have a lot to add”, but may incriminate you and your colleagues if you were to do so. I also believe the public has a right to know who “tampered with” these documents. A fact, the Ombudsman’s found in her investigation.

The Office of Treaty Settlements has never, responded to me in previous correspondence about the matters I put in my letter date the 17 February 2008. They are matters I believe that you, as one of the people involved at the time and in sending Mr Titford a Deed that had been “tampered with” could answer. Paul, documents do not “tamper with themselves”, someone has to do it!!

Paul, you should have a long hard think about this. The Deed you sent to Mr Titford on the 1 November 2006 was “tampered with”. You were very involved with the documents when they arrived back in New Zealand. You, and others were very concerned about Mr Titford’s amendment “alleged” and would have known it would destroy the claim if the public found out and would make the agreement to acquire Mr Titford’s property “null and void”. You also must have known the Deed was a compiled document with the amended page removed and was not the Deed Mr Titford had signed in Tasmania. You did not know we had a copy of the memo showing the Deed you sent us had been “tampered with”. I believe, you must know who tampered with the Deed!!

The Ombudsman concluded, Sam Samec, the Crown’s lawyer “tampered with” page 11 of the Sale Agreement before he returned it to New Zealand and the Crown Law Office “tampered with” the Sale Agreement by removing the memorandum “To attach to the liabilities” before the Crown signed it, so who “tampered with” the Deed?

Hopefully Paul, you will reconsider answering the questions from the Ombudsman’s investigation I put to you in my letter dated the 17 February 2008. We will find out, but it would be far easier for all concerned and less painful for those involved, continuously looking over their shoulder, to tell us now.
